CDA given more time to submit reply

Capital Development Authority (CDA) here Tuesday sought more time from the Islamabad High Court (IHC) to submit inquiry report against its own official who permitted Safa Gold Mall to construct 7 stories instead of the approved building plan of 4 stories.

Justice Aamer Farooq of the IHC while accepting CDA’s request granted time till September 19 and adjourned the hearing.

Meanwhile, a person who is constructing cinema house at the 8th story of the same building has filed an application to become a party in this matter. IHC bench on the said application issued notices to the CDA and owner of Safa Gold Mall.

On August 5, IHC bench at the writ petition of Safa Gold Mall, through an interim order, had conditionally allowed the mall to de-seal subject to a payment of Rs220 million payable to the CDA and removal of all encroachments in surrounding of the mall area.

CDA on July 28 had sealed the mall in the Jinnah Super Market for violating original layout plan.

In this particular matter CDA has been adopting that the mall owner violated original lay out plan where he was permitted to construct 4 stories and he instead constructed 7 while 8th was under construction.

Mall owner on the other hand had adopted that he got permission from the civic body to construct more stories. CDA has been adopting that the said approval was not granted by the CDA board that is competent authority in this matter. Further, CDA also holding an inquiry against official who permitted the Mall administration to construct more stories. IHC bench previous date of hearing had directed CDA to submit inquiry report but CDA told that inquiry is still going on.
