PESHAWAR: The Peshawar High Court (PHC) on Tuesday set aside the death sentence of two persons in a murder case. A two-member bench comprising Justice Qaiser Rashid and Justice Asadullah Khan Chamkani acquitted Rohullah and Arif after hearing arguments from both the parties and the state lawyer.
As per the first information report (FIR), both the persons were charged with murdering Wali Rehman on January 27, 2012. A subordinate court had awarded death sentence to them, which they challenged in the high court.
Waqas Khan Chamkani, counsel for the appellants, submitted that there was a conflict in the statements of the witnesses that showed that his clients were falsely implicated in the case. He requested the court to set aside the decision of the subordinate court and acquit the appellants. The law officer and counsel for the complainant defended the decision of the trial court.
