Petition against flyover construction dismissed
PESHAWAR: The Peshawar High Court (PHC) on Wednesday dismissed a writ petition filed against construction of a flyover under the Bus Rapid Transit (BRT) project and ordered the construction companies to continue work on the flyover.
A division bench comprising Justice Qaiser Rashid Khan and Justice Muhammad Ayub Khan dismissed the petition. It was filed by Mudasir Ahmad, a resident of Chamkani area. He had sought an order from the court to stop work on the construction of the flyover.
The petitioner claimed that the flyover was not part of the BRT project and requested the court to declare it illegal.
During the course of hearing, additional advocate general, Syed Sikandar Ali Shah said the flyover was part of BRT project. He said the Maqbool-Calson-China Engineering joint venture had been awarded the contract for the construction of the mega project and the companies working within in limits of the project, which part of the PC-1.
The additional advocate general said through the BRT thousands of citizens would get jobs and also would have an international standard transport facility in the city. He informed the bench that the companies had continued work on the project day and night and any hurdle and hindrance could delay in completion of the project in time.
The additional advocate general also informed the bench that the PHC bench No 1 had given a detailed judgment on the BRT project and declared the PC-1 of the project lawful. He said the PHC was still monitoring the work and public problems due to BRT and receiving progress report of the project through Human Rights Cell of the court.
