ISLAMABAD: The Islamabad High Court has given permission to Indian citizen Uzma to go back to India, remarking if she does not want to talk with her husband Tahir Ali, the court will not force her.
The IHC took up for hearing a petition filed in respect of dispute over marriage between Indian citizen Uzma and her Pakistani husband Tahir on Wednesday. Uzma had filed a petition in the IHC, seeking permission to return to India while his husband Tahir Ali filed a petition, seeking permission to meet his wife. Uzma was brought to the IHC under security while she fell unconscious on reaching the courtroom.
The counsel for Uzma informed the court that she was feeling unwell due to mental stress, therefore, her condition deteriorated. Her medical check-up was carried out in court dispensary and later she went back from court. The court directed Uzma to record her statement freely, and remarked that this matter is between husband and wife and no third person should have any objection.
The court, while taking into consideration the medical report of Uzma’s daughter, allowed her to go back to India and adjourned the hearing till next week. Talking to mediamen, the counsel for Uzma said her client does not accept the marriage, therefore the possibility of any meeting between her and Tahir stands ruled out. Meanwhile, counsel for Tahir said the court has not said that the Nikah Nama is fake.
