ISLAMABAD: Justice Aamer Farooq of the Islamabad High Court (IHC) here Thursday dismissed a petition seeking directions for the federal government to make General Raheel Sharif Field Marshall.
IHC bench while dismissing this application observed that there is no post like Field Marshall in the Constitution of Pakistan. Further a court cannot direct legislature to form new law, it said. Petitioner sought that Gen Raheel may be elevated to the rank of Field Marshall for rendering his services for national security. The petition was filed by lawyer Sardar Adnan Saleem Khan Mazari through his counsel Raja Saimul Haq Satti advocate.
He had cited federal government through Secretary Cabinet Division, Prime Minister of Pakistan and secretary defense as respondents. Petitioner adopted that the exemplary, outstanding and professional performance during peace and war time with total dedication and devotion by the Chief of Army Staff (COAS) needs national appreciation, award and recognition. Petitioner contended that in Constitution, there is no mention of tenure/period of a COAS.
