ISLAMABAD: The Supreme Court (SC) on Friday asked the Khyber Pakhtunkhwa (KP) chief secretary under which law members of the assembly were given development funds.
The apex court issued notices to the chief secretary, the special secretary to the KP chief minister and others in the provincial annual development funds case.
When the SC division bench headed by Justice Ejaz Afzal took up the case for hearing, counsel for JUI-F MPA Malik Riaz said that KP Chief Minister Pervaiz Khattak denied funds to his client while releasing Rs320 million to a union council Nazim.
Justice Tariq Pervez remarked if the funds had not been provided, the matter should be taken up in the provincial assembly. ”How has your right been breached by providing funds to the UC Nazim?” he asked.
The counsel for Malik Riaz said that the chief minister was not entitled to release the funds in such a manner.
Justice Tariq Pervez inquired which law prevented the chief minister from providing funds. The counsel told the court that the chief minister was not authorised to provide funds to Nazims.
The court, while serving notices on the chief secretary, the special secretary to the KP chief minister and others, adjourned the hearing for one week.
