ISLAMABAD: The federal government has requested the Chief Justice of Pakistan (CJP) Justice Nasirul Mulk to nominate three judges for the Judicial Commission (JC) to investigate the alleged rigging in the 2013 general elections.
The request was made through a letter, addressed by the Ministry of Law, Justice and Human Rights through the federal secretary law, to the CJP to constitute the commission pursuant to Section 2 of the General Election 2013 Inquiry Commission Ordinance, 2015 (VII of 2015).
According to Section 2, there shall be constituted a commission to be called the General Election 2013 Inquiry Commission, hereinafter referred to as the Commission, for carrying out the purpose of this ordinance.
The commission shall comprise three judges of the Supreme Court which shall be constituted by the CJP on the request of the federal government. There shall be a chairman
of the commission to be nominated by the CJP from among the three members of the commission.
Provided the Chief Justice of Pakistan is a member of the commission, he shall act as the chairman. The Parliamentary Affairs Division shall provide the secretariat support to the said commission.
Last week, the Pakistan Muslim League-Nawaz (PML-N) and Pakistan Tehreek-e-Insaf (PTI) signed an agreement on the constitution of the proposed commission for launching a probe into the alleged rigging.
Finance Minister Ishaq Dar flanked by PTI leaders Shah Mehmood Qureshi and Jehangir Tareen had told a press conference that efforts will be made to issue the presidential ordinance that would pave way for the constitution of the Judicial Commission.
APP adds: The Supreme Court Tuesday received the Law Ministry’s letter, requesting the formation of Judicial Commission.The SC registrar received the letter and forwarded it to the Chief Justice of Pakistan.
