LAHORE: The Lahore High Court (LHC) has adjourned till next week hearing of appeal plea against single bench decision for nullifying judicial magistrate decision to discharge former Chief Minister (CM) Punjab Chaudhry Pervez Elahi from the case .
A division bench of LHC presided over by Justice Shehram Sarwar Chaudhry took up the appeal plea for hearing Monday.
During the hearing of the case Advocate General (AG) Punjab Khalid Ishaq and counsel for the petitioner sought time for preparation.
The court while accepting plea gave time to the lawyers of the respondents.
It was taken stance in the appeal that single bench decision runs contrary to law. Judicial magistrate is empowered to discharge any accused from the case for want of evidence. Single bench declared baseless and null and void the decision of judicial magistrate. The single bench decision for presenting him for physical remand again be declared annulled.
