LAHORE
A division bench of the Lahore High Court Thursday barred National Accountability Bureau (NAB) from proceedings against businessmen Ahmed Hamayun and Ahsan Hamayun for being defaulters of a bank loan.
The court referred the matter to chief justice for constitution of a larger bench to settle issue of willful default.
The petitioners pleaded through their counsel that they borrowed loan from Punjab to invest the same in stock market.
However, they returned the loan along with the mark-up. However, they said, the NAB started investigation against them on charges of loan default and State Bank had also taken up the matter.
The petitioners pointed out that a suit was pending before the LHC with regard to the loan dispute.
They prayed to the court to stop the NAB from taking action against them till decision of the suit pending before the court.
A division bench headed by Justice Mahmood Maqbool Bajwa restrained the NAB from taking coercive measures against the petitioners and referred the petition to a full bench to decide a point of willful default. Over 100 petitions were already pending on the point of willful loan default. The full bench is yet to be constituted.
CJ: Lahore High Court Chief Justice Manzoor Ahmad Malik on Thursday visited newly-constructed Judicial Complex and directed the chief engineer to complete the final touches within two days.
Shifting of all scattered courts in the city to the new judicial complex has already been started.
The chief justice is likely to inaugurate the new complex on Oct 12. All central courts, accountability courts, drug courts, banking offence courts, consumer court, anti-corruption courts, anti-narcotics court, and a yet to be functional special court established under Protection of Pakistan Act are going to be shifted to one premises of the Judicial Complex.
