PHC disposes of contempt petition as NHA tenders apology

PESHAWAR: The Peshawar High Court (PHC) disposed of a contempt of court petition against the National Highway Authority officials after withdrawing its notice against the construction company of the Pakistan Muslim League-Nawaz leader Amir Muqam and tender apology.

A division bench comprising Justice Roohul Amin Khan and Justice Syed Afsar Shah disposed of the contempt of court petition after the NHA officials withdrew its notice to the M/S AM and Company (AMC), and tendered an apology.

A construction company owned by the Pakistan Muslim League-Nawaz (PML-N) leader Amir Muqam had filed a contempt of court petition against the NHA officials for non-compliance with the court orders.

M/S AM and Company (AMC), through its manager operation, Zia, had filed a contempt of court petition against the NHA officials for non-compliance with the court orders restraining them from the recovery of Rs152.8 million from the company till disposal of the petition.

The petition was filed through Barrister Syed Mudassir Ameer. The NHA officials and secretary, Ministry of Communications, were named contemnors in the petition. The petition stated that the high court on January 31 passed an order in the writ petition of the petitioner company, restraining the respondent officials of NHA from the recovery of Rs152.85 million from the company till the next order. However, the petitioner claimed that despite the court orders, the NHA officials were pressuring the BoK’s Mingora branch officials to encash the petitioner’s bank guarantee to them.

It was also submitted in the petition that the NHA officials were pressuring the company for recovery of the funds on the insistence of the Pakistan Tehreek-e-Insaf federal minister due to political rivalry with the PML N leader.
