ISLAMABAD: A Christian woman has filed a petition with the Islamabad High Court (IHC) seeking dissolution of her marriage under Section 7 of Christian Divorce Act 1869.
The Act was suspended during the tenure of Gen Zia-ul-Haq and later it was restored by a Lahore High Court (LHC) bench on June 20, 2017.
Under Section 7, a Pakistani court in Christian matrimonial and divorce issues has to follow the English law where divorce is possible unlike the religious injunctions of Christianity where there is no concept of divorce, a lawyer told the petitioner.
Earlier, a family court judge while hearing the application of Nazia Riasat on October 20, 2017 dismissed the application to the extent of dissolution of marriage and converted it into judicial separation.
Later, the ADSJ court also dismissed her appeal under Section 10 of Christian Divorce Act 1869 and now she has filed a petition with the IHC seeking divorce under Section 7. Justice Aamer Farooq of the IHC would hear in this matter today on Friday.
Court also observed that it would not intervene in the policy matters of the government
