NEW DELHI: A man, convicted of raping a widow after trespassing her house, has been awarded seven years rigorous imprisonment by a Delhi court which relied on the victim’s statement.
Additional Sessions Judge Virender Bhatt handed down the jail term to Delhi resident Ranjeet while holding him guilty of the offences of rape and house-trespass under sections 376 and 451 of the IPC respectively.
The court said that prosecution successfully established that it was the accused who had gained forcible entry into the woman’s flat when she was sleeping and committed the offence. It also imposed a fine of Rs 20,000 on the convict, a father of three minors.
The court, while convicting him, observed that there was nothing adverse in the conduct of the woman and it is “quite natural that the incident may have sent her into a state of shock, despair and distress.” It also relied on the medical report of the victim which proved her allegations.
According to prosecution, the woman was alone at her flat on the intervening night of September 17-18, 2014 when Ranjeet entered her house and raped her after gagging her mouth.
When she tried to raise alarm, Ranjeet went back to his flat in the same building and the victim called up her daughter who was at work at that time, it said, adding that a police complaint was lodged and he was immediately arrested from his house.
