ISLAMABAD: Supreme Court’s constitutional bench adjourned the hearing of the super tax case till Friday (today).
A five-member bench, headed by Justice Amin-ud-Din heard the case on Thursday. Makhdoom Ali Khan, the counsel for the companies, argued that there was a clear objective behind the imposition of the super tax. He said the tax was meant to be utilised for the rehabilitation of devastated areas, but no details had been provided since 2015 regarding how much tax was collected and where it was spent. He further contended that the Supreme Court’s earlier order in this matter had not been implemented.
Justice Jamal Khan Mandokhail remarked that if such an act is introduced in the future and passed by both houses of parliament, would the act then be framed properly. Responding to the bench, Makhdoom Ali Khan said proper policy must be made to pass such an act.
Justice Muhammad Ali Mazhar inquired, “Have you seen the court decisions of Karachi and Peshawar?” The counsel replied that lawyers’ arguments were similar in the court decisions of both cities.
