PHC dismisses cops’ writ petition
PESHAWAR: The Peshawar High Court (PHC) on Friday dismissed the writ petition by four police officials filed against the sub-ordinate court decision of ordering registration of first information report (FIR) in a murder case of a trader, who was allegedly killed by police in the Nowshera district.
A two-member bench comprising Justice Waqar Ahmad Seth and Justice Musarrat Hilali dismissed the writ petition of four police officials, including Inspector Akhtar Gul, Assistant Sub-Inspectors (ASI) Syed Nabi Shah, Aman Sher and a constable Waliullah, filed against the order of sub-ordinate court.
As per the prosecution and police report, the petitioners are serving at the Risalpur Police Station in Nowshera. It was stated that on April 13, during checking the police signaled a car to stop, but a man driving the car started firing at the police party. It said the police returned the fire, killing the man, who was later identified as Kamandan. The court was informed that one constable Naqibullah was also killed in the firing by the driver of the car.
They requested the court to cancel the court’s order as the Kamandan mother got the court order regarding the FIR against the police officials in her son murder case.
However, the lawyer for the complainant submitted before the court that Kamandan was a cloth trader . He prayed the court to dismiss the petition and maintain the sub-ordinate court decision against the police accused persons about registration of FIR of the murder of the trader.
