SC reserves verdict on ex-CJP Dogar’s plea
ISLAMABAD: The Supreme Court of Pakistan on Wednesday reserved its verdict on former chief justice of Pakistan (CJP) Abdul Hameed Dogar’s plea to annul the Special Court order regarding fresh investigations into the high treason case.
A three-member bench of the court headed by Justice Asif Saeed Khosa and comprising Justice Tariq Masood and Justice Tariq Pervez heard the petition filed by former CJP Dogar, challenging the IHC refusal to hear his plea against the verdict of the Special Court in the high treason case.
Justice Asif Khosa remarked that the court would see whether the Islamabad High Court or the Special Court had the authority to issue orders in the case. There was no article in the Constitution to stop a trial, he said.
Barrister Farogh Naseem, counsel for former president Musharraf, told the bench that the federal government had told the IHC that it was ready for fresh investigations into the high treason case. He said if the former CJP was not agreeing to re-investigations, why he gave consent before the court.The attorney general told the court that it was the federal government authority to include the name of an accused in investigations.
