KARACHI: The Sindh High Court (SHC) on Wednesday directed the counsel of Axact to place on record the list of all vehicles that were alleged to have been seized or detained by the Federal Investigation Agency.
The court warned that in case of failure in filing of such list, it shall be presumed that all allegations made by the plaintiff were incorrect and appropriate order shall be passed. The direction came on lawsuit of Axact against seizure of its vehicles from its employees. Axact company and its fleet officer Mohammad Aslam filed lawsuit against FIA official against seizure of vehicles from its employees.
Their counsel Rafiq Kalwar submitted that FIA officials demanded list of vehicles being used by all employees of Axact and later on they seized the vehicles from the residences of the employees.
He submitted that act of the respondents was beyond the scope of investigation being conducted by the FIA relating to fake degree scam. He submitted that vehicles of the employees were part of their package for which a sizable amount was deducted from their salary; therefore, confiscation of vehicles by the FIA was illegal. The court was prayed to declare that act of defendant to seize the vehicles of Axact employees was illegal and order release of vehicles.
FIA director legal Israr Ahmed filed comments on behalf of FIA submitting that list was moved to Excise and Taxation Department for not allowing transfer of present status of vehicles. He submitted that no physical possession of such vehicles took place and no vehicle individually owned by an employee or jointly registered in the name of Axact has been seized for investigation.
Additional Attorney General Salman Talibuddin also made statement submitting that not a single vehicle has been confiscated or seized by the FIA. The SHC single bench headed by Justice Nadeem Akhtar directed the Axact counsel to place on record list of such vehicles that were allegedly detained or seized by the FIA without fail on next date of hearing.
