The Sindh High Court (SHC) on Tuesday issued notices to federal as well as provincial law officers and law enforcement agencies on a petition against detention of Moazzam Ali Khan.
Currently on a 90-day physical remand for allegedly facilitating the murder of Muttahida Qaumi Movement’s (MQM) leader Dr Imran Farooq in London in 2010, the detainee’s wife Saida Bano, in her petition maintained that Khan was picked up by Rangers’ personnel from his house situated in Azizabad, block 8, on April 12 - a day earlier of his official arrest.
She submitted that family members had approached the Azizabad police station to inquire about his whereabouts but the SHO refused to give any clue of the detainee.
The court was pleaded to direct the Sindh home secretary, the director-general of the Sindh Rangers, the IG Police, the SHO Azizabad and other officials to produce the detainee in the court of law along with the details of the criminal case, if any made against him.
The SHC’s division bench headed by Justice Naimatullah Phulpoto issued notices to the deputy attorney general, the provincial advocate general and prosecutor general to file their comments by May 14.
The bench also heard petitions against detention of three more citizens including a government employee by the personnel of the law enforcement agencies.
Petitioners Ahmed, Gul Badshah Khan and Habibun Nisa submitted that police and Rangers personnel had taken Shahid, Mir Badshah and Syed Babur Hussain Jaffery into custody from Lyari, Jamshed Road and Surjani Town areas respectively but their whereabouts remained unknown.
The counsel of the petitioners submitted that neither of the law enforcement agencies’ was disclosing the whereabouts of the detainees neither have they been notified of their official arrest.
The court was prayed to direct the official respondents to produce the detainees before the court and provide details of the charges filed against them.
