PESHAWAR: Ignoring merit, the Pakistan Tehreek-i-Insaf (PTI) government has posted its 73 blue eyed non-cadre officers from grade 17 to grade 20 cadre posts. The decision violates Supreme Court orders by not returning these officers to their respective departments. In 2013, the Supreme Court’s three-member bench had ordered to immediately return all the non-cadre officers to their respective departments.
According to documents, many officers while going against the Esta Code remained appointed on the cadre posts in 2007 and 2008 even after their deputations completed their tenure. However, it is important to notice that a deputation’s duration is only three years at maximum. There can be a further increase of two years in this set duration.
In 2013, the Supreme Court’s three-member bench, comprising Justice Amir Hani Muslim, Justice Tassaduq Hussain Jillani and Justice Asif Saeed Khosa, in its 140-page long decision, declared that no non-cadre officer can be adjusted on a cadre post or a scheduled position.
According to sources from the Establishment Department, professors and teachers in the Education Department were appointed on cadre posts too. In this regard, Secretary Establishment and Administration Arshad Majeed told The News that he does not having enough information about this issue. Similarly, various attempts to contact Special Secretary Tanzeela also failed.
Though this list has been provided by the government itself, it does not clarify the question that whether the Supreme Court verdict bars the appointment of an officer as secretary in his own department, or posting of an official to his own department’s secretariat in his own pay and scale?
According to the Establishment Department’s letter dated Dec 5, number (RTI)2014/10_SO(HRD-II)ED/1 Arshad Aziz Malik, Grade 20’s five non-cadre officers are working on the cadre posts, who include Welfare Services Officer Fazal Nabi Khan as Secretary Welfare, Department of Canals’ Engineer Muhammad Naeem Khan in Energy and Electronics, CNW’s Engineer Muhammad Atif made Secretary CNW, Secretariat Group’s Tariq Rasheed made Secretary Department of Canals and Police Services Officer Imtiaz Altaf made Chairman Governor Inspection Team.
Secretariat Group’s grade 20 officer Tariq Rasheed is deployed in KPK since Dec 16, 2011. Police Group’s Imtiaz Altaf is deployed as Chairman Governor Inspection Team since February 8, 2017. The interesting thing is that Professor Muhammad Attaullah Shah is posted as General Manager FDA, which is an institution under the Governor's Secretariat—deployed in the secretariat since 2009.
According to the government documents, Grade 19’s non-cadre officers are similarly deployed on cadre posts, including Information Technology Officer Khalid Khan who was made Secretary Elementary and Secondary Education, Fisheries Services Officer Shaukat Ali Yusufzai made Additional Secretary Agriculture, FD Officer Muhammad Qasim made Director of Small Industries Development Board, Associate Professor Attaullah Shah made General Manager Fata Development Authority, Protocol Serivce’s Qaisar Alam made Secretary Information, P&D Officer Dr Asad Ali Khan made Director General Rescue 1122 Department, Department of Elementary and Secondary Education Officer Zulfiqar Ali made Deputy Secretary CM Secretariat, Deputy Solicitor (Lawyer) Shakeel Asghar made Additional Secretary of Law Department, P&D officer Ali Raza Khan made Director General SDU, Department of Health SPO Adil Saeed made Coordinator PM&RU, Secretariat Group’s Secretary Sports Muhammad Tariq also deployed in the province since 2012 for deputation.

Secretary Administration and Establishment Arshad Majeed was contacted about these developments. In response, he said that he does not have enough information about this issue and Special Secretary Madam Tanzeela would comment better. On the other hand, three attempts were made to contact Special Secretary Tanzeela on the phone number 9210069. Her PA answered the call and responded that she was busy in a meeting. We requested her PA to let her call us back, but that didn't happen.
