Distribution of inheritance case: SC gives one-week time for settlement to disputing parties

ISLAMABAD: Chief Justice of Pakistan (CJP) Qazi Faez Isa on Wednesday observed that there should not be a quarrel over the distribution of inheritance, saying only a calculator can solve the dispute.

A three-member bench of the apex court, headed by Chief Justice Qazi Faez Isa and comprising Justice Irfan Saadat Khan and Justice Naeem Akhtar Afghan, heard a case related to the distribution of inherited property, a house of one kanal and 5 marlas in Lahore.

During the course of hearing, the counsel for petitioner, Rana Akhtar Hussain, told the court that another case of the property’s land is pending with the Punjab government. The counsel requested the court that the said property should not be divided till the decision of the pending dispute is announced.

The chief justice remarked that in Saudi Arabia, the day a case of inheritance is filed, the judge gives a decision on the same day.

“There should not be any dispute over the distribution of inheritance. Only a calculator is needed,” the CJP remarked. “We also get good things from the society as well.”

The chief justice asked the parties’ counsels whether they will go against the Sharia in the holy month of Ramazan.

“The court wants you to act in peace and mercy in the holy month of Ramazan,” the CJP said. He observed that the procedure is very clear and asked the parties as to what they wanted.

The chief justice asked the parties whether they wanted the property to be sold or be divided.

The petitioner then sought time to decide over it. On this, the court adjourned the hearing till March 21, giving one-week time to both the parties to settle the issue.
