PHC told case registered against ex-wife of Azam Hoti

PESHAWAR: The Federal Investigation Agency (FIA) on Tuesday informed the Peshawar High Court (PHC) that in compliance with the court’s order, the Cyber Crime Circle has registered First Information Report (FIR) against Shamim Akhtar Kiyani a former spouse of late Senator Azam Khan Hoti for sharing and uploading private family pictures on Facebook.
Director Legal of the FIA, Muhammad Imran, and Investigation Officer Fazal Mabood submitted the copy of the FIR filed against Shamim Akhtar Kiyani, the former spouse of late Senator Azam Khan Hoti, father of former chief minister Ameer Haider Hoti in the high court.
A two-member bench comprising Justice Waqar Ahmad Seth and Justice Irshad Qaiser disposed of the contempt of court petition against the FIA officials after submitting FIR against Shamim Akhtar Kiyani.
Humaira Azam Hoti, had filed the contempt of court petition through her lawyer Sabitullah Khan Khalil, against the FIA officials for not taking action and blocking the Facebook website and page on which private family photos of the petitioner and her family members are being run by Shamim Akhtar Kiyani along with obscene comments.
The FIA Cyber Crime Circle registered the FIR on the complaint of Humaira Azam Hoti on April 14, 2016.It was stated in the FIR that during the course of inquiry it transpired that the accused Shamim Akhtar Kiyani with malafide intentions and ulterior motives to malign and defame the complainant and her family, illegally uploaded private pictures of the complainant with obscene, indecent comments on the Facebook account.
“A case under sections 36 and 37 ETO 2002 read with section 109 of PPC is made against the accused Shamim Akhtar Kiyani. The FIR lodged after permission from competent authority,” the report stated.Earlier, late Senator Azam Khan had filed the petition against his former wife.
During hearing of the petition, the petitioner’s lawyer Sabitullah Khalil told the court his client’s ex-wife Shamim Akhtar Kiyani had been using social media to upload various pictures and videos which were damaging the reputation of her former husband who is an incumbent senator and former federal minister.
Shamim Akhtar Kiyani has been engaged in a long legal battle with her late former husband over non-payment of dower and the inaction of the police against him.
On March 20, 2015 Kiyani attempted self-immolation in front of the Islamabad police chief’s office, but the policemen deployed at the gate snatched the matches and jerry can of petrol from her. Later on, Rawalpindi police registered a case against Azam Hoti on the directives of the court, following an application filed by Kiyani on charges of him threatening her.
Kiyani initially filed a suit against Hoti demanding Rs110 million in mehr as promised in the nikahnama. The civil suit was later withdrawn on assurances of Hoti to pay the money which was not eventually paid. The matter is still pending in the Supreme Court.
