PESHAWAR: The Peshawar High Court (PHC) on Friday granted bail before arrest to a person charged with terrorism and booked under the Telegraph Act on a complaint of a military officer.
A single bench of Justice Musarrat Hilali issued the bail before arrest to Shehryar Chohan till the next hearing into the case.The court also issued notice to military officer, Brigadier Salim Sher. He was directed to submit his reply in the bail before arrest application.
During hearing, the petitioner’s lawyer Barrister Waqar submitted that the Tank Police Station on the complaint of Brigadier Salim Sher booked the petitioner. He stated that the military officer claimed in the complaint that the petitioner had given him serious threats through SMS and telephone calls and obstructed him from performing his official duty.
However, he submitted that the petitioner belonged to a respectable family and was relative of the military officer. He informed the court that the petitioner and the complainant had a land dispute.
The lawyer informed the bench that some days ago the military officer went to the hujra (male guesthouse) of the petitioner and harassed his employees. The petitioner phoned him up in retaliation, said the lawyer. He contended that it was a civil dispute between the petitioner and the complainant, adding his client had been charged wrongly in the first information report with a malafide intention.
Court also observed that it would not intervene in the policy matters of the government
