PESHAWAR: The Peshawar High Court (PHC) on Monday restrained the city police from arresting four Afghan refugees under Section 3 of the Maintenance of Public Order (MPO).
A division bench comprising of Justice Waqar Ahmad Seth and Justice Musarrat Hilali suspended the arrest warrant issued by the deputy commissioner of Peshawar and stopped the police from arresting the four Afghan refugees till next order of the court.
The bench issued notice to the deputy commissioner to submit reply and explain the reasons for the arrest of the Afghan refugees under MPO.
The four Afghan refugees, including Yousaf, Ghulam Mufti, Sohbat and Raz Muhammad, living at Regi Lalma in the limits of Nasir Bagh Police Station, had challenged their arrest under the MPO through their counsel, Sohail Akhtar.
The lawyer submitted before the bench that the Afghan refugees were living peacefully and were not involved in any criminal activities.
Separately, the same bench also suspended notification of the Quaid-i-Azam College of Commerce, University of Peshawar (UoP) restraining 15 students of M.Com from annual examination. It directed the college administration to allow the students to appear in the examination. The bench issued notice to the principal and coordinator for the college, asking them to explain their position for stopping the students from the exam of their final semester.
Zaigham Khurshid, a final year student of M.Com in the Quaid-e-Azam College of Commerce, had challenged the notification restraining the students from appearing in the exam.
