Row over Bacha Khan Markaz ownership

PESHAWAR: A local court on Friday dismissed an application of Awami National Party (ANP) President Asfandyar Wali Khan filed for cancellation of the claim of Begum Nasim Wali Khan of the ANP-Wali about possession of the property of Bacha Khan Markaz.
Civil Judge Tufail Ahmad dismissed the application of the ANP chief after hearing arguments from both sides.In the application, the ANP chief stated that Bacha Khan Markaz was an asset of the party as it was constructed using party fund.
It stated that the claim of Begum Nasim was false so the suit filed for seeking the possession of the Markaz should be dismissed.The court directed the respondents, including ANP chief Asfandyar Wali Khan and its provincial head Ameer Haider Hoti, to submit rejoinder in the suit before the next hearing.
Begum Nasim Wali had filed the suit through Qazi Mohammad Anwar and Hamid Toofan advocates.Nasim Wali insisted she had built the Bacha Khan Markaz after purchasing the land and was, therefore, the rightful owner of the property.
Nasim Wali launched ANP-Wali in February 2014 and asked ANP President Asfandyar Wali to vacate Bacha Khan Markaz and hand it over to her party.In the suit, Nasim Wali requested the court to declare that she was the absolute owner of the Bacha Khan Markaz building constructed on four kanals of land.
She requested the court to declare that Asfandyar Wali and Haider Hoti had no right to the property and this principle also applied to the defendants, their successors or associates.
Nasim Wali said her father-in-law Khan Abdul Ghaffar Khan (Bacha Khan) had launched the Khudai Khidmatgar Movement in the erstwhile NWFP. She added that the movement was later extended to Balochistan and the Federally Administered Tribal Areas.
She said Bacha Khan had constructed a building in Sardaryab area before the creation of Pakistan. She said it was known as Bacha Khan Markaz and was the headquarters of Khudai Khidmatgar Movement.
