Court orders FIR registration against Pesco chief, others over negligence

PESHAWAR: A local court on Friday ordered the registration of the first information report (FIR) against Peshawar Electric Supply Company (Pesco) chief, officers and employees and police officers for their negligence as an electricity transmission line installed just above the ground damaged the right hand and foot of a minor girl.

Additional Sessions Judge Javaidur Rehman ordered the capital city police officer to register the FIR against Pesco chief, superintendent Anees Khan, SDO Safiullah, and six other Pesco employees under the relevant laws.

The court ordered the registration of the FIR against the DSP and SHO Matani Police Station for their negligence to investigate the case and also ordered initiation of a departmental inquiry against the police officers.

The verdict stated that the petitioner Jamal Sher, a resident of Peshawar, is seeking registration of case against the respondents under Section 22-A Criminal Procedure Code (CrPC), alleging that an electricity line of 11000 KV has passed near his house and it was very low and had caused several accidents. It was stated that the matter was repeatedly reported to the quartered concerned and the Pesco employees concerned, but to no avail.

It said the daughter of the petitioner, Fahmeed Kashmala, 6, went out to the fields where the low-lying electricity lines hit her, due to which the right hand and the fingers of the right foot were cut off, in addition to other injuries. It said that the occurrence took place on September 15, 2017.After necessary treatment of the daughter, the petitioner approached the SHO concerned for registration of FIR against the respondents, but to no avail.

The transmission line is installed very low and the occurrence took place due to negligence of the respondents. “The respondents (officers and employees of Pesco) being cruel and notorious used to extend threats to the petitioner to settle the matter by their whims and wishes,” the order stated.

Similarly, the order stated that the respondents including SDO and superintendent and Pesco chief had also illegally installed the same transmission line and hence they were also reluctant to settle the issue, which will further result in such incidents.
