PTI answers to JC’s questions based on official statements

ISLAMABAD: If one goes by thousands of public statements made by the PTI leadership during the sit-in speeches and press conferences, it’s absolutely easy for the PTI counsel to respond to the questionnaire given by the Judicial Commission (JC) probing the alleged rigging during 2013 elections.
The following would be the PTI’s answers to the commission’s questions on the basis of publicly made official statements of its leaders,
1. (a) Do you allege that the general elections 2013 were not organized and conducted impartially, honestly, fairly and justly in accordance with the law?
Ans: Yes. The province of KP was an exception.
(b) If so, specify why?
Ans: It was done to steal the mandate of people which was in favour of the PTI and to convert this mandate in favour of PML-N.
(C) Please indicate the material and witnesses which you will rely on in support of your allegation.
Ans: 1- Najam Sethi-Nawaz Sharif telephonic tape. The tape will be forensically verified by some internationally reputed lab like those of Scotland Yard in the UK. 2- Nadra thumb impression verification reports of 38 constituencies each of which establish that 60 to 70 percent thumb impressions were unverifiable. 3- Because the PML-N government had agreed on the formation of Judicial Commission. 4- A list of 13 witnesses, including anchor person Hamid Mir, has already been furnished with the august commission.
2. (a) Do you allege that the 2013 general elections were manipulated or influenced pursuant to a systematic effort by design by anyone?
Ans: Yes. Please note, it was not manipulated by anyone in the KP.
(b) If so, please provide following details:-
A (i)- Who made the plan/design?
Ans: Nawaz Sharif, former Supreme Court judge Justice Khalilur Rehman Ramday, Members of ECP.
(ii)- The material and witnesses which you will rely on in order to support your allegation.
Ans: It is not a trial of a criminal case so threshold of the evidence should be considered.
B (i)- What was the plan/design?
Ans: To frustrate (puncture) the real mandate of the people by rigging, to defeat PTI and to make PML-N victorious so it can form government in center. It was planned to print fake ballot papers, to place fake stamps and to do stuffing.
C (i)- Who implemented the plan/design?
Ans: Former Chief Justice Iftikhar Muhammad Chaudhry, all Returning Officers of Sindh, Punjab and Balochistan. Najam Sethi, Geo News, ECP member from Punjab, two senior ECP officers.
(ii)- The material and witnesses which you will rely on in order to support your allegation.
Ans: 1- Forensically-tested recording of Nawaz Sharif-Najam Sethi secret phone call about 35 punctures. (Not attached) 2- Recovered fake ballot papers. (not attached) 3- Witnesses who heard that Justice Ramday was communicating with ROs. 4- Documentary evidence that ROs changed results during the night of May 11, 2013 as finally compiled results are different from those announced on Polling Stations. (Copies not attached) 5-Copy of recording of Geo News airing Nawaz Sharif speech at 11:24 pm in which he announced his victory. (Copy of CD attached). 6 - Recording of ECP member visiting polling stations exactly when polling was in progress. 7- Najam Sethi video in which he is saying that bureaucrats were reporting to Raiwind along with the evidence how these officers manipulated election process and changed the election result (video attached, evidence not attached.) 8- Statement as witness of Muhammad Afzal, former ECP official which also established rigging.
D (i)- How the plan/design was implemented?
Ans: Justice Iftikhar Chaudhry addressed ROs before the election day and they changed results on the night falling between 13th and 14th of May 2013 after Nawaz Sharif’s speech on Geo News at 11:23 pm. Justice Ramday consistently remained in touch with ROs and guided them how to change results coming to them from different polling stations of the respective constituencies. ECP senior officials managed printing fake ballot papers which were given to Khawaja Saad Rafiq, a PML-N candidate in NA-125, which changed results of rest of constituencies. Finally, Najam Sethi called Nawaz Sharif informing him that 35 punctures had been successfully executed.
(ii)- The material and witnesses which you will rely on in order to support your allegation.
Ans: As mentioned in response of C(ii), but please keep in mind it is not a trial of a criminal case and decision of the commission should be based on ‘circumstantial evidence’ and perception.
3. (a) Does “systematic effort” as mentioned in S.3 (b) include just the National Assembly (NA) seats or Provincial Assembly (PA) seats as well?
Ans: Yes, the National Assembly as well as three provincial assemblies of Sindh, Punjab and Balochistan. Please note that there was no rigging on the National Assembly seats falling in the KP. Also there was no rigging on 4 seats of Sindh Assembly and 23 seats of Punjab Assembly.
(b) If NA only, does it include all 4 provinces or just confined to certain provinces?
Ans: This point is clarified in answer to above question.
When The News approached senior PTI leader Ishaq Khakwani who also heads the PTI committee collecting rigging evidences, he said their answers to questions given by the commission were not finalised yet. However, earlier Khakwani confirmed to this reporter that all what the PTI chief had stated regarding rigging in May 11 elections was true and his party had evidences to that effect which will be presented before the commission.
