PESHAWAR: The Peshawar High Court (PHC) has stayed the appointment of director Areas Study Centre in a writ petition filed against the appointment through an illegal manner till the next order of the court.
A two-member bench comprising Justice Yahya Afridi and Justice Musarrat Hilali stopped the vice-chancellor University of Peshawar (UoP) from appointing the director of the Areas Study Centre of the university.
The bench issued the direction in the writ petition by Dr Parvez Iqbal Tareen, senior-most professor of the Area Study Centre.The bench also directed the vice-chancellor and registrar of the UoP to submit detail replies and explain their position for appointing the director against the set criteria.
During hearing of the case, the petitioner’s lawyer Muhammad Ijaz Sabi submitted that before the 18th Amendment to the Constitution, the director of the Area Study Centre was to be appointed by the federal Ministry of Higher Education, but now the post would be filled by the vice-chancellor of the university.
He submitted that the vice-chancellor and registrar of the UoP issued an advertisement for the post of director Area Study Centre, in violation of the set criteria for the post under the University of Peshawar (Amendment) Act, 1974.The lawyer pointed out before the bench that the violation of set criteria had greatly affected the petitioner.
He said the petitioner is possessing the qualification of PhD in International Law from State and Law Academy of Sciences, Moscow, Russian Federation and LLM from faculty of Law, Tashkent State University and has 23 years experience as he had been performing duty in the Area Study Centre since June 1992.
