The NAB ordinance is not applicable to members of the armed forces (other than those who might be working or are posted outside the armed forces). Is this because the armed forces have, for some reason, a different standard of accountability from all other public officeholders? If this is correct – and while I am sure that the armed forces have excellent standards of ensuring accountability if there is any wrongdoing within the armed forces – is this not against the spirit of one set of laws for all citizens of Pakistan?
I also saw in Article 9(b) that all offences under the NAB Ordinance are of a non-bailable nature. Is this because the authors of the NAB ordinance took great care to ensure that punishments under the NAB ordinance should be as humane as possible? It would be great if these questions are answered by the competent authorities.
