Polo Club case suspended
LAHORE: The Lahore High Court on Tuesday suspended proceedings before a civil court on a suit against Lahore Polo Club.
A member of the club, Naveed Sheikh, had filed the suit before the civil court against cancellation of his membership. The polo club challenged the civil court’s proceedings before the high court.
The club’s counsel Taffazul Haider Rizvi argued that the club was a registered company and respondent Naveed Sheikh was one of its members. He said an extraordinary general meeting of the club first suspended membership of Naveed Sheikh, later terminated him for his constant misconduct.
The counsel stated that as the Polo Club was a company registered in 1934; therefore, under the Companies Act, 2017 all disputes between member and the company fell under the exclusive jurisdiction of company judge of the Lahore High Court and the civil court had no jurisdiction in this regard. He asked the court to set aside the impugned proceedings pending before the civil court for being unlawful. After hearing the arguments, Justice Shahid Bilal Hassan suspended the civil court’s proceedings and issued notice to the respondent for March 9.
