Through their qualification and vast experience civilian judges are obviously far better placed to dispense justice compared to their counterparts in the military. However, even the best of judges need an enabling environment to give optimum performance.
Also, working under many constraints, most of which are not of the judiciary’s own making, and beyond its or even government’s capacity to remove within weeks or months, we are left with military courts as the only interim and practical solution – though certainly not an ideal one. Also, this will provide time for formulating comprehensive reforms, thus making the military courts unnecessary in due course.
