ISLAMABAD: A two-member bench of the Supreme Court on Tuesday discharged a petition seeking the elimination of interest system in the country.
Heading the bench, Justice Sarmad Jalal Osmany remarked: “We cannot open a seminary outside the Supreme Court to teach the people about the elimination of interest.”
He remarked that those who did not want to take interest should not take it while those getting it will be answerable to Allah on the Day of Judgement.
“The Supreme Court is the protector of the Constitution; we cannot open a seminary outside the Supreme Court to teach the people about the elimination of interest,” he added.
“Let us accept that interest is Haram (forbidden) in totality but this case is under hearing in the Shariat Court already and the Supreme Court cannot hear it until the court’s judgement,” he observed.
In his arguments, Raja Irshad, the counsel for the petitioner, told the bench that the apex court was the guardian of the Constitution and prayed that the interest system be abolished.
