First UK information commissioner resigns in 42-year history

John Edwards, the UK's Information Commissioner, has resigned effective immediately following an independent workplace investigation. His departure marks the first resignation in the role's 42-year history and signals institutional turmoil at Britain's data protection watchdog.

Edwards admitted on Friday that he had shown "poor judgement and made attempts at humour that were inappropriate and offensive". Though he did not agree with the ICO's investigation, he agreed that his position had become "untenable".

The Information Commissioner's Office is responsible for regulating the use of AI technology in the UK, enforcing data protection laws, and implementing the freedom of information legislation. Edwards had held this position since January 2022 until he stepped down from his duties in February after the investigation started.

This is the first time any information commissioner has resigned since the office was created in 1984. Jon Baines, a top data protection expert at Mishcon de Reya, described this as "extraordinary circumstances".

Edwards' departure coincides with government plans to replace the ICO with an Information Commission, requiring recruitment of a new chair. 

The resignation of Edwards comes at a time when there is increasing condemnation regarding the poor performance of the ICO. 

Campaign groups like the Good Law Project and the Open Rights Group have taken legal action against the regulatory body for its actions that have been characterised by them as "blithely ignoring thousands of public data complaints".

Open Rights Group Executive Director Jim Killock said, "It is an opportunity for the government to appoint a regulator who has some teeth."
