Artificial Intelligence’s ability to generate hyper-realistic pictures and videos has blurred the boundary between reality and fiction.

In one of the scariest developments, AI-generated evidence has made its way to the court and this trend could possibly undermine the court’s ability to distinguish truth from falsehood.

In a California housing dispute, AI-generated video evidence was submitted to the Alameda County Superior Court where Judge Victoria Kolakowski serves.

She observed that the Exhibit 6C, presented during court proceedings, was a “deepfake”, noting several features that helped her reach the conclusion. 

The witness’s voice was disjointed and monotone, a fuzzy face that lacked emotions.

The case was dismissed on September 9, 2025. 

The plaintiff accused that the judge failed to produce evidence of Exhibit 6C being AI-generated; however, Judge Victoria dismissed the review petition on November 6, 2025.

Judges and legal experts have noted that the first recorded incident in which a deepfake was submitted to the court as authentic evidence is a sign of a much larger threat.

In an interview with NBC News, the judge said that the courtrooms are still dealing with AI in its infancy, adding, “No one has figured out the full implications of such a threat.”

Other judges, even those strongly advocating the use of AI in judicial matters, have expressed concerns over generative AI’s threats to the pursuit of truth.
