KARACHI: The Sindh High Court (SHC) on Friday disposed of lawsuit of Axact against seizure of its vehicles from employees by the federal investigation agency directing the FIA to act strictly in accordance with the law.
Axact company and its fleet officer Mohammad Aslam filed lawsuit against FIA official against seizure of vehicles from its employees. Their counsel Rafiq Kalwar submitted that FIA officials demanded list of vehicles being used by all employees of Axact and later on they seized the vehicles from the residences of the employees and by calling them at FIA office.
The counsel of the plaintiff had submitted that vehicles seized by the FIA have been released except one Mercedes Benz. However, the additional attorney general vehemently denied the claim of the plaintiff and submitted that Mercedes Benz vehicle was not in custody of the FIA and for time being the said vehicle was not required by the FIA.
The counsel of the plaintiff submitted that suit may be disposed of by giving direction to the defendant investigation agency to act strictly in accordance with the law and not to harass or intimidate the plaintiffs or the employees of the plaintiff.
SHC’s single bench headed by Justice Nadeem Akhtar observed that it is well settled principal that courts do not interfere in the investigation in criminal cases however at the same time, the investigation agencies are duty bound to act in accordance with the law of the land. The court observed that it is an admitted position that number of cases against Axact are being investigated by the FIA therefore they cannot be restrained from investigating into the matter/cases.The court disposed of the lawsuit and listed applications with direction to the defendants to act strictly in accordance with the law.
