A legal expert has opened up about whether Britney Spears’ decision to seek professional help following her DUI (driving under the influence) arrest would help her before the judge.

For those unaware, the Princess of Pop was taken into custody for driving while intoxicated in Ventura County, California, on March 4, 2026. For violating driving rules, she was booked into Ventura County main jail but was released on March 5.

On April 12, Spears voluntarily went into a treatment facility to achieve sobriety, as her DUI arrest embarrassed her before the whole world.

While conversing with PEOPLE magazine, Bobby Taghavi, former prosecutor in the Orange County District Attorney's Office and managing partner at personal injury law firm Sweet James, explained how the 44-year-old American singer’s move could help her, as she will appear in court on May 4, 2026.

Taghavi said, “[Voluntarily seeking treatment] shows the court and prosecutors that the person is taking the situation seriously before they're ordered to do anything. Judges tend to respond better to proactive accountability than last-minute ‘damage control.'”

He stated that the Femme Fatale songstress’ decision might help her avoid jail and that she can be ordered to enrol in education programs and seek counselling with strict probation terms.

Still, “It's not a guaranteed shield from custody, [but] most judges view it favorably as mitigation, especially when it's documented, consistent, and shows real commitment,” the expert quipped.

However, “the court will still look at the underlying facts, and judges prefer proof of participation or completion, not just an announcement,” Taghavi noted.

It is pertinent to mention that Britney Spears’ sons, 20-year-old Sean Preston and 19-year-old Jayden James, whom she welcomed with her ex-husband Kevin Federline, encouraged her to seek treatment.

An insider told the same outlet, "Her sons were a big part of getting her to rehab. They've been clear with her. They just want her to be healthy.”

“She was very upset and shaken after her arrest. And she's terrified of going to jail. It's taken weeks for her to realize that going to rehab is the best option,” stated the source.
