PHC cancels bail of two charged with rape
PESHAWAR: The Peshawar High Court on Monday cancelled the bail of Faizullah and Adil Shah, who had been charged with raping a minor, Muneeba.
A bench led by Justice Ijaz Anwar announced the verdict. Previously, the bail had been granted by an additional sessions judge in Peshawar.The application for bail cancellation was filed by Muneeba through her father.
Advocate Nouman Muhib Kakakhel, representing the petitioner, argued that the additional sessions judge had erroneously granted bail to the accused due to the absence of a medical report. The judge should have waited for the investigation office to submit the report.
The counsel highlighted that a medical report from the forensic laboratory, issued two days after the bail was granted, confirmed the minor had been raped. He stated that the offense is punishable by death or life imprisonment, falling under the prohibitory clause.
