PHC orders prisoner’s admission in law college
PESHAWAR: The Peshawar High Court (PHC) ordered the admission of an under-trial prisoner to the Master of Law (LLM) programme at the University of Peshawar on Thursday.
A division bench of the PHC, comprising Justice Syed Muhammad Attique Shah and Justice Wiqar Ahmad, heard a writ petition filed by under-trial prisoner Tufail Zia, who sought admission to the LLM while undergoing imprisonment.
Advocate Nauman Muhib Kakakhel, while representing the petitioner, argued that his client had applied for the LLM programme at the Khyber Law College, University of Peshawar, while being an under-trial prisoner and a lawyer by profession. He had subsequently cleared the requisite test.
The counsel contended that the petitioner was not called for the interview despite being on the merit list, whereas those below him on the merit list were called. He argued that all fundamental rights of prisoners remained intact and only their movement was curtailed.
After hearing the arguments of the petitioner’s counsel, the division bench ordered the University of Peshawar to admit the petitioner to the next session of the LLM programme based on his current admission form and test results without fail.
