Charlie Kirk murder case: Utah judge weighs probable cause against Tyler Robinson

A Utah judge is weighing whether prosecutors have presented sufficient evidence to send the case against Tyler Robinson to trial for the killing of conservative activist Charlie Kirk.

Robinson, 22, is charged with aggravated murder and six other counts, including tampering with evidence. Because it is an aggravated murder charge, he could face the death penalty if convicted.

Investigators state that Robinson fired a single shot from a nearby building on September 10, striking and killing the 31-year-old Kirk while he was speaking to a crowd at Utah Valley University in Orem.

The decision follows preliminary hearings where prosecutors laid out their evidence to establish probable cause. The defense has previously challenged aspects of the case, including filing motions regarding media coverage and public access.

Beyond the basic evidence, the defense has actively tried to block the death penalty, arguing that the shooter hit the intended target rather than endangering the broader crowd.

Meanwhile, prosecutors point to DNA testing tying Robinson to the rifle and alleged statements indicating political motivations.

If State District Judge Tony Graf determines that probable cause has been met, the case will advance to an arraignment where Robinson will officially enter a plea, setting the stage for a high-profile trial.
