ISLAMABAD: The Supreme Court Tuesday asked the Bahria Town counsel Barrister Ali Zafar to explain reasons for his apprehension about a fair trial by a bench headed by Justice Jawwad S Khawaja.
Barrister Ali Zafar Monday submitted an application to the Chief Justice of Pakistan (CJP) seeking transfer of Bahria Town-Punjab Forest Department land dispute case to another bench.
A three-member bench headed by Justice Jawad S Khawaja while hearing the case in short order ruled that Bahria Town was a corporate entity and therefore it could not have apprehension of its own but someone in the Bahria Town had cast aspersions.
The court directed Ali Zafar to inform it as to who had apprehension and what was its basis and adjourned the hearing till April 2.The court order observed that the bench, headed by Justice Jawwad S Khawaja also heard a number of cases filed by various individuals against Bahria Town and Ali Zafar represented the Town, adding that those cases were decided in favour of Bahria Town but the learned counsel did not raise any objection at that time.
