Stay orders are normally issued by courts at various levels of a trial to provide temporary relief to an aggrieved party followed by detailed proceedings where guilt or innocence is established. Whereas the primary purpose behind stay orders is to safeguard the interests of an aggrieved party it may not be so in many cases. You talk to any lawyer and he will tell you that the easiest and quickest thing to get from courts is an stay order, especially in cases relating to property disputes. Many times such actions have resulted in unnecessary delays in obtaining justice. Cases linger on in courts for months and sometimes for years.
Therefore, there is a dire need to review the system of stay orders, especially on property-related issues. The spirit behind the issue of stay orders is good but the system is being manipulated in such a way that only those who are rich and can hire a good lawyer eventually benefit.

The Axact scandal – dubbed as one of the biggest scandals of the country – was made possible due to a broken justice system. With so many checks available in the country one is surprised the fake-degree awarding company operated its dubious business for so long.
But on a closer look it is clear that organisations like FIA, the SECP, HEC, etc, have all been stopped from investigating the case through ‘stay orders’. The stay order has become a tool in the hands of corrupt and scrupulous elements and can be termed one of the root causes of all social ills in the country.
