Lindsay Clancy update: Her lawyer unveils strategy to avoid another trial
Lindsay Clancy's case hearing is set for September 29
For days, the jury deliberated and argued over whether Lindsay Clancy is guilty.
But ultimately, it ended up in a mistrial.
Now, at a hearing set for September 29, the mom-of-three lawyer has unveiled his strategy to dismiss the case against her client.
"It will be a motion to dismiss based on what's called double jeopardy grounds, because there's no … manifest necessity," attorney Kevin Reddington told CBS News.
"You have to have a manifest necessity to declare a mistrial for obvious reasons — the invested time that the jurors put into it, the court, the staff, the defendant, the prosecution, everybody."
But apart from that, at the heart, what possible outcomes are there in Clancy's case?
The first can be simple. Reddington asks the judge for a not-guilty ruling. This, however, can be far-fetched.
Prosecutors could retry Clancy with a new jury.
A deal between the prosecutors and the defense team is also possible.
Last but not least, prosecutors are not pushing for a second trial; however, that is highly unlikely.
