Approximately 6 million valid claims were submitted in BCBS settlement lawsuit
After years of legal back-and-forth, the $2.67 billion Blue Cross Blue Shield (BCBS) antitrust settlement has finally moved into its payout phase as of May 2026.
The settlement stems from a decades-long class-action lawsuit alleging that BCBS engaged in anticompetitive practices by limiting it in the health insurance market.
In this legal battle, BCBS was also accused of drawing up geographic territories to avoid competing with one another, thereby driving up healthcare costs for consumers along with reduced choices.
Blue Cross Blue Shield has denied these allegations but agreed to settle the lawsuit.
Financial breakdown
While the headline figure is $2.67 billion, the actual amount being distributed to claimants is lower after legal and administrative expenses.
Gross settlement fund: $2.67 billion
Net settlement fund: Approximately $1.9 billion after cutting down roughly $700 million in attorney fees and costs.
The estimated average payout is roughly $300-$333 per valid claim, but the figure can vary depending on individual premium history, such as how long you were enrolled in BCBS coverage, the amount of premiums you paid, type of insurance coverage, and number of total approved claims.
Talking about total claims, approximately 6 million valid claims were submitted.
Eligibility for claiming pay out
Following criteria should be met to claim the payments. The deadline to file the claims was November 5, 2021. If you have missed the deadline, you are ineligible for this payout.
One must have also been covered by a BCBS plan during the following windows:
- Individuals & fully insured groups: February 7, 2008 – October 16, 2020
- Self-funded accounts: September 1, 2015 – October 16, 2020
When and how to receive payment
The payout process officially began in early May 2026. The payments are being issued according to the method selected by claimants, including direct deposits, physical checks, and electronic transfers.
The end of a historic antitrust battle has arrived as Blue Cross Blue Shield begins issuing settlement checks. For the six million people and businesses that filed claims years ago, this month marks the long-awaited arrival of their payouts.
