The Peca balance
The increasing usage of digital platforms in Pakistan has, unfortunately, coincided with a rise in societal polarisation and the spread of misinformation. This environment necessitates a framework to regulate these spaces and ensure responsible communication. The recent amendments to the Pakistan Electronic Crimes Act (Peca) 2016, extending its scope to digital platforms and addressing fake news, misinformation and defamation, reflect the government's attempt to grapple with these
challenges. However, concerns persist regarding the law's potential for misuse
and its impact on freedom
of expression.
Journalists and media advocates worry that the amendments could be used to suppress dissent and critical reporting. To mitigate these risks, it is crucial to refine the law by establishing clear definitions, focusing on intent, ensuring independent oversight, safeguarding journalistic activities and upholding due process. A balanced approach that acknowledges the need for regulation while protecting fundamental rights is essential for fostering a healthy digital ecosystem in Pakistan.
