PESHAWAR: The Peshawar High Court (PHC) on Tuesday dismissed a writ petition
challenging the death sentence awarded by a military court.
A two-member bench comprising Chief Justice Mazhar Alam Miankhel and Justice Qaiser Rashid dismissed the writ petition filed by Muhammad Ayaz against the death sentence of his brother Muhammad Imran, resident of Mohmand Agency.
The petitioner’s layer Muhammad Arif Jan said that the bench dismissed the petition in light of the court’s previous judgment in similar cases. He said that the petitioner wanted to file appeal in the Supreme Court, where other such cases were pending.
The petitioner claimed that his brother Muhammad Imran had studied at the Islamia College, Peshawar, and remained a student of Jamia Binoria in Karachi for four years.He claimed that the security forces picked up his brother in 2008 and the family members met him during his detention.
He said that on January 1, 2016, the family came to know through media about his death sentence by a military court in a case of attack on security forces and his involvement in terrorism incidents.
