Special inheritance courts on the cards in KP

PESHAWAR: The Peshawar High Court (PHC) has decided to establish special inheritance courts at the divisional level across the province for the immediate resolution of inheritance cases.

The sources said that the special inheritance courts would also be set up at the district and tehsil levels as well where initially senior civil judges would be appointed to these inheritance courts with the appellate courts of session judge at the divisional level.

The sources also revealed that special benches for inheritance cases were being established at all the benches and principal seats of the PHC. It was reported that PHC Chief Justice Ishtiaq Ibrahim took notice of the complaints regarding delays in inheritance cases and approved the establishment of these courts for the first time in the province’s history.

The sources added that first the data of pending inheritance cases had been collected. Over 5,500 cases related to inheritance have been pending for several years.They also revealed that the PHC CJ immediately directed the PHC registrar to notify the establishment of inheritance courts at the divisional level, followed by appellate courts for which necessary steps have been taken to set up the courts in question.

It has also been reported that the PHC CJ was personally overseeing the entire process, and special inheritance benches were being notified at various benches of the PHC to ensure that all cases were resolved promptly.

The establishment of inheritance courts is aimed at providing timely justice to the litigants and reducing the burden of cases.Special training would also be provided to judges handling these cases to ensure their timely resolution.According to statistics, the highest number of inheritance cases is currently in Peshawar.
