Advocate Nauman Muhib Kakakhel represented the accused. The counsel argued that the accused was born to a Pakistani/Afghan couple and was, therefore, a Pakistani Citizen by descent under Section 5 of the Citizenship Act 1951. The counsel argued that the mother of the accused was a Pakistani woman who had moved the Peshawar High Court seeking grant of Pakistan Origin Card for her husband and citizenship for her children.
