Restraining order sought against Halle Berry
Halle Berry's ex moves court for sole custody with allegations she physically abused their 12-year-old son
Halle Berry's ex, Olivier Martinez, is asking for sole custody of their 12-year-old son, Maceo, after accusing the actress of physically abusing him.
Martinez, 60, filed a petition for a temporary restraining order against Berry, also 60.
He claims that on Saturday, Sept. 26, Berry jumped on Maceo, put her hands around his neck and choked him. He says the boy called him to pick him up, saying his mother had attacked him and that it was not the first time.
Martinez alleges Berry grabbed Maceo by the neck and shouted, "Who is dominant now?" He says her fiancé, Van Hunt, was there and defended the boy.
The filing also claims there were other incidents over the past few years, including physical attacks on Maceo and verbal and emotional abuse.
Martinez says Berry downplayed it, claiming she was joking. He points to her MMA training and alleges she put Maceo in chokeholds and wanted him to "tap out."
The filing includes texts Berry allegedly sent. In one, she said her son is disrespectful and feels she has no say. When Martinez asked if Maceo could stay with him, she allegedly replied she was not okay with it. Martinez's attorney told People, "Our paramount concern is the health, welfare of the child."
Berry and Martinez finalised their divorce in 2023. Under their agreement, they share joint legal custody, and Berry pays Martinez $8,000 a month in child support.
In May 2024, they agreed to co-parenting therapy to help resolve disputes. Berry is also mom to daughter Nahla, 18, with ex Gabriel Aubry.
