IHC issues notice to respondents in JIT challenge case
Counsel said that as per rule 2 the DG should be competent officer in regard to electronic crime
ISLAMABAD: Islamabad High Court (IHC) has issued notice to the respondents on the petition whereby the JIT that has summoned PTI leaders has been challenged.
The court has sought reply till April 21. The court, while directing Sheikh Waqas Akram and others to appear before JIT, has said you have challenged vires and you should appear therein and file reply.
Justice Raja Inam Ameen Minhas heard the case on Wednesday. The counsel for the petitioner said in his arguments notification of July 26 has been challenged.
Federal government constituted JIT under Peca which is running under IG.
This JIT is illegal under section 30. Notification regarding re-constitution of JIT runs contrary to section 30. The counsel said that as per rule 2 the DG should be competent officer in regard to electronic crime.
The court inquired you are saying rules have been violated here too.
The counsel said yes rules have been violated. The counsel told the court that JIT was to conduct investigation regarding social media campaign. Officer of investigation agency should be head of JIT and IG cannot head.
FIA and investigation agency investigate regarding cybercrimes and not the police.
This is all job of National Cybercrime investigation agency. Some time they say old agency has been abolished and new has come. Some time they say old has been revived. The court while issuing notice to the respondents adjourned the hearing till April 21.
