Establishment of military courts under 23rd Constitutional amendment has been challenged before the Supreme Court.

Barrister Zafarullah Khan of Watan Party filed a petition at Lahore registry of the apex court pleading that the establishment of the military courts is against the basic spirit of the Constitution. He contended that Article 175 of the Constitution defines separate rules for executive and judiciary. Therefore, he said, administrative officers cannot be appointed as judges. The petitioner requested the court to strike down the 23rd amendment.
