Non compliance of court order on fee: PHC issues contempt of court notice to school
PESHAWAR: The Peshawar High Court (PHC) on Tuesday issued contempt of court notice to principal and manager accounts of Saint Mary’s High School, Peshawar Cantonment, for not complying with the court’s decision on annual and promotion fee of the students.
A two-member bench comprising Chief Justice Yahya Afridi and Justice Roohul Amin Khan issued the notice to the respondents. They were directed to appear before the court of Justice Waqar Ahmad Seth today, who had passed the decision.
The bench issued direction in the contempt petition filed by Ali Iqbal Qazalbash against the principal and manager accounts of the school.
The petitioner submitted that his son Hussain Ali Qazalbash has been enrolled at the Saint Mary’s High School since 2013.
He said that the court had also declared that there should be complete ban on all types of dues, charges, extra annual plus tuition fee and its increase in any school from nursery up to the intermediate.
The petitioner claimed that on March 3, 2018, the respondents gave a fee voucher which includes annual charges along with late fee fine and a letter for next academic session 2018-19, which also includes annual charges of Rs7,000 and 10 percent revised fee amounting to Rs3,300 which is in violation of the court’s judgment.
He stated that he approached the respondents for redressal of grievances as per the court’s judgment, but in vain.
The petitioner said that on the result day, the school had awarded his son a distinction certificate along with honour badge, but the same along with annual result card for the session 2017-18, class 4th was not only taken back, but also banned his entry to the school for one month.
The Private Schools Regulatory Authority Khyber Pakhtunkhwa had issued a public notice in the newspapers to fully comply with the court’s judgment.
