Tayyaba torture case: IHC to hold trial

ISLAMABAD: Justice Aamer Farooq of the Islamabad High Court (IHC) here Friday, while announcing a decision regarding trial jurisdiction in the matter of torture of a juvenile maid Tayyaba, has decided to hold the trial at IHC.

Naowa IHC instead of the court of judicial magistrate Syed Haider Ali Shah, will conduct trial of the additional district & sessions judge (ADSJ) Raja Khurram Ali Khan and his wife Maheen Zafar.

On March 8 a three-member Supreme Court bench headed by Chief Justice of Pakistan Mian Saqib Nisar had stopped the judicial magistrate from continuing proceedings and directed IHC to consider relocation of the trial under section 526 of CrPC for fair trial.

The IHC bench dismissed an application of the Civil Society represented by Asma Jehangir that had also been demanding relocation of the trial. IHC bench dismissed this application on the basis of 'locus standi' or the person is not directly aggrieved.

Justice Aamer Farooq had reserved order in this matter on March 17 after parties concluded their arguments.

IHC bench deciding trail jurisdiction has observed that the case has been shifted to ensure transparency in this matter.
